MODIFICATION OF THESE TERMS OF USE
The Zone reserves the right to change the terms, conditions, services and notices under which the KarnesCorner Web Site is offered, including but not limited to the charges associated with the use of the KarnesCorner Web Site. All changes shall be effective and deemed accepted by all users upon posting of such changes on the KarnesCorner Web Site. That version will then apply to all use(s) by you following the date of publication. Each access of information from The Zone will be a separate, discrete transaction based on the then prevailing terms. These Terms of Use and Service, and the license(s) granted by it may not be assigned or sublet by you without The Zone’s advance written consent.
COPPA
The online privacy of children under the age of 13 is protected by federal law, and The Zone takes all steps necessary to afford the highest protection possible. For that reason, The Zone does not knowingly permit children under the age of 13 to become registered members of its sites, or to buy goods and services on its sites, without verifiable parental consent. The Zone does not knowingly collect or solicit personal information about children under 13, except with their parent’s express consent. If we ever include children under the age of 13 as part of our intended site audience, those specific web pages will, in accordance with the provisions of the Children’s Online Privacy Protection Act (COPPA), be clearly identified and provide an explicit privacy notice; and we will provide processes to obtain parental approval, provide access to information and allow parents to request removal of their children’s personal information.

The Zone does not assume any responsibility or risk for your use of the Internet, and you agree to hold The Zone harmless from any and all, verifiable or unverifiable damage resulting from your use thereof.
SUBSCRIPTION TERMS
Use of certain, identified segments of the KarnesCorner web site family; including, but not limited to its “MemberZone” area require the payment of a monthly subscription service fee. Each user agrees to pay to The Zone a monthly subscription fee, in advance, via Pay Pal, credit card or other method from time to time as established by The Zone, for each month’s use of those protection portions of the KarnesCorner Web Site. Each user authorizes The Zone to automatically debit the payment source or mechanism associated with his or her registered account for each monthly subscription fee. Monthly subscription fees are not refundable for any reason. Automatic debits shall continue unless and until the user terminates the subscription in accordance with these terms and conditions. For termination of your access and rights to the KarnesCorner Web Site, and/or to cancel your subscription please send your request to zonersupport@karnescorner.com.
The Zone may, from time to time, establish special promotional “trial offers,” at its discretion, under such terms and conditions as may be posted on the KarnesCorner Web Site(s). The Zone may provide access to, or use of the promotional or trial offers using promotion codes, coupons , credits or other mechanisms, at its sole discretion. Promotional or trial offers may be modified or terminated at any time, at The Zone’s discretion, and will, in any case, be limited to one offer per user. At the end of any promotional or trial offer period, the user’s credit card, Pay Pal account, or other approved payment source will automatically be debited for each subsequent subscription period, and such automatic debits shall continue unless the user terminates the subscription during the trial period, in accordance with the terms and conditions for termination of the applicable section(s) of the KarnesCorner Web Site(s).
During any such trial offer, user understands and accepts that The Zone may verify user’s future payment method (credit card, PayPal, e-check information, other) by requesting The Zone’s payment processing provider “authorize,” but not “capture” a sum equal to, or less than, one payment unit for the subscription / membership type selected by user during the trail period. The purpose of such “authorization” is to confirm the authenticity of user’s future payment method, and that such account is active and capable of communicating with The Zone’s payment processing provider in transacting future processing requests if / when user continues his / her / its subscription and/or membership after the expiration of any such trail period. User further understand and accepts that, depending on the payment method or type provided by user to The Zone, user may receive what appears to be an order confirmation notification / receipt from The Zone’s payment processing provider for the amount “authorized;” however, any such notification / receipt is a part of the automated confirmation process only, and does not reflect an actual charge upon or against user’s account.
Promotional or trial subscriptions provide the user with access to limited portions of the protected segments of the KarnesCorner Web Site family. The entire KarnesCorner Web site suite will be made available only to users paying the complete monthly subscription fee for a given subscription level during a given month.
From time to time, The Zone may provide its members and/or its site visitors with access to offers or promotions made available by or from third-parties. If, as a member or site visitor, you provides an e mail address or other information to such a third party, The Zone will not be responsible for the use of the information so provided.
CANCELLATION AND REFUND
KarnesCorner members participating in the Premier, Elite, or Diamond Elite programs understand their subscription term is month to month, and is automatically renewed unless cancelled. Members are free to cancel at any time by logging in to the KC MemberZone web site at http://www.karnescorner.com/memberzone, selecting the Home link under the Member Control Center (located at the top, left column of the page), and from the Subscription Home Page, clicking on the Cancel link under the Product column of the Payment History section. Cancellations will take effect on the first day of the following month’s billing cycle, and members are free to enjoy their subscription, uninterrupted until such date.
If a member’s subscription includes a free trial period, such “test drive” will expire after 15 days, at which time the month to month, automatic renewal, subscription service will commence, unless member cancels said subscription prior to the expiration of the 15th day of that trial period.
Cancellations performed after a particular billing date, and where the subscription payment has been charged, will effect cancellation for the succeeding month. In such cases, the subscriber shall be responsible for payment of the succeeding month and will have no right to stop payment or backcharge for that month.
KarnesCorner members participating in the Diamond Elite Plus (DEP) program understand their subscription term consists of an initial 60 day, jump start period, followed by a month to Monthly Maintenance program that is automatically renewed unless cancelled. Members further understand and accept that space in KC’s DEP program is limited, and, therefore, to assure reasonable, fair and sufficient resources are available to meet the ongoing needs of all DEP members, The Zone must set aside such resources at the time of activating said member’s DEP’s jump start subscription; and such allocations may preclude The Zone from accepting additional, prospective DEP members. Therefore, in order to assure sufficient resources are allocated and available, the DEP, 60 day, jump start subscription fees are non-refundable, in full or in part once the first one-on-one coaching session has been scheduled, or reasonable attempts to schedule same by The Zone personnel produce no definitive results for or a period of 10 from the date of registration. Prior to scheduling the first one-on-one coaching session and/or up to and including the 10 day period upon which The Zone personnel are attempting contact to schedule same, members are free to cancel their DEP subscription at any time for a full refund. To voluntarily cancel under the terms and conditions referenced above, a member must contact The Zone by phone at 631-873-4812, ext. 416, or by email at zonersupport@karnescorner.com, with the words “Voluntary DEP Refund” typed in the subject line, in order to assure the refund process is properly commenced. Simply logging in to the Member Control Center and clicking on the Cancel link will only discontinue future, automatic billing of Monthly Maintenance program renewals - will not initiate the refund - and may jeopardize the member’s standing to claim said refund if no documented communication is reached within the 10 day contact period.
In addition, if, after the initial one-on-one coaching session, said member expresses, in writing, within 48 hours thereafter, dissatisfaction with said coaching session, and/or the DEP program, and if The Zone, at its sole discretion, believes the dissatisfaction is fair, reasonable and justified, said member may receive a pro-rated refund of up to 80% of the initial “jump start” program fee, with such refund amount determined solely, and at the complete discretion of The Zone. Such expressions of dissatisfaction should be emailed to zonersupport@karnescorner.com, with the words “DEP Cancellation Request” typed in the subject line of the email.
Applicable DEP program refunds will be issued to a member in the same manner, using the same processing method as was the member’s original payment to The Zone. For example: If member paid with a credit card, that credit card will be reimbursed for the refund amount due. If the member paid using their PayPal account, that account will be issued a credit for the refund amount due. Member’s subscription will be cancelled immediately upon processing of the applicable refund.
With respect to the ongoing Monthly Maintenance portion of DEP, members understand their subscription is automatically renewed each month, unless cancelled. Members are free to cancel the monthly maintenance program any time by logging in to the KC MemberZone’s web site at http://www.karnescorner.com/memberzone, selecting the Home link under the Member Control Center (located at the top, left column of the page), and from the Subscription Home Page, clicking on the Cancel link under the Product column of the Payment History section. Cancellations will take effect on the first day of the following month’s billing cycle, and members are free to enjoy their subscription, uninterrupted until such date.
Cancellations of the monthly maintenance portion of DEP which are performed after a particular billing date, and where the subscription payment has been charged, will effect cancellation for the succeeding month. In such cases, the subscriber shall be responsible for payment of the succeeding month and will have no right to stop payment or backcharge for that month.

The KarnesCorner Web Site(s) may contain links to other Web Sites (”Linked Sites”). The Linked Sites are not under the control of The Zone, and The Zone is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Zone is not responsible for web-casting or any other form of transmission received from any Linked Site. The Zone is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by The Zone of the site or any association with its operators.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the KarnesCorner Web Site(s), you warrant to The Zone that you will not use the KarnesCorner Web Site(s) for any purpose that is unlawful or prohibited by these terms, conditions, and notices. TERMINATION/ACCESS RESTRICTION

SEVERABILITY

You agree to treat as strictly private and confidential any Subscriber Code, username, user ID, or password which you may have received from The Zone, and all information to which you have access through password-protected areas of The Zone’s Web site family, including, but not limited to the KarnesCorner web site(s), and will not cause or permit any such information to be communicated, copied or otherwise divulged to any other person whatsoever. The Zone will be entitled to monitor your password and, at its discretion, require you to change it. If you use a password that The Zone considers insecure, The Zone will be entitled to require the password to be changed and/or terminate your account. You are prohibited from using any services or facilities provided in connection with The Zone’s web site family to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, The Zone reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents. The Zone reserves the right to investigate suspected violations of these Terms of Use and Service.
BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS COMPANY FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY COMPANY DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER THE COMPANY OR LAW ENFORCEMENT AUTHORITIES.
